Is the "I tried to shoot the autistic guy to death, & missed & hit the guy on the ground" defense really going to hold water for anyone? .

I mean, seriously, how is intended lethal force against anyone that doesn't seem to be an imminent threat ever defensible? Clearly, if the guy felt comfortable enough to lie on the ground and put his hands up in the air to keep the cop from shooting him, he was also comfortable enough with the situation to know that the autistic man was not going to kill him. ‎· Mr. Noodle
