And you are correct. So far --I was trying to shoot the other guy-- is the leader by a nose. My amazement is that some folks are assuming this is a plausible defense, without acknowledging that other guy didn't need to be shot either. :\
Well you can never be too sure... A scenario that I haven't investigated is the "they don't shoot white people in similar circumstances" scenario. It's almost a meme. But I haven't seen any data or serious reporting exploring it. I did see some reporting the other day that claimed that whites and blacks are shot by police at about the same rates. However the interactions between police and black people and the escalation to violence within those interactions are much higher. I dunno.
It may bear out that the officer was well within procedural realms for firing. I really hope not. But the law and order zealots, er aficionados within my circle of friends have indicated that the choke hold applied to Eric Garner and some of the other shootings were "well within procedural limits" which I find troubling in the least. About the only incident that they've universally decried is the shooting of Walter Scott in North Carolina.
